Upper Coomera Classes Service Agreement: Craft to Commerce (Market Stall Program)

This Service Agreement is made between the NDIS participant (the Participant) in the National Disability Insurance Scheme (NDIS) and ACN 662 160 643 Pty Ltd trading as Upper Coomera Classes (the Provider).

This Service Agreement is made for the purpose of providing supports under the Participant's National Disability Insurance Scheme (NDIS) plan. This agreement is a legally binding contract between the Participant and the Provider and outlines the terms and conditions for the provision of NDIS supports and services. It is to be completed prior to commencement of any activity or class. The Service Agreement will be forwarded to the relevant Support Coordinator and/or Plan Manager.

  1. Background: This Agreement is entered into in the context of the National Disability Insurance Scheme (NDIS), which aims to support the independence and social and economic participation of people with disability and enable them to exercise choice and control in the pursuit of their goals.

    The Provider agrees to provide the Participant with the supports and services detailed in the attached Schedule of Supports (Attachment A).

    The Participant's funding is managed as:

    • Self-managed
    • Plan-Managed (by their Plan Manager)
    • NDIA-managed
    • Combination of the above
  2. Participant's Goals and Outcomes: The supports provided under this Agreement are designed to help the Participant achieve the following goals and outcomes, as outlined in their NDIS plan:

    • Develop new skills in art and craft.
    • Enhance social interaction and community participation.
    • Increase confidence and self-esteem through creative expression.
    • Explore opportunities for economic participation through the sale of created products.
  3. Purpose of this Service Agreement: The purpose of this Agreement is to clearly outline the responsibilities of both the Participant and the Provider to ensure a shared understanding of:

    • The supports and services to be delivered.
    • How and when the supports will be delivered.
    • The cost of the supports.
    • The responsibilities and obligations of both parties.
    • How to handle issues, complaints, and changes to the agreement.
  4. Term of Agreement This Agreement will commence on [Start Date] and will remain in effect until [End Date], or until terminated in writing by either party in accordance with the terms of this Agreement.

  5. Responsibilities of the Provider
    • Provide supports and services that meet the Participant's needs and goals, as outlined in the Schedule of Supports.
    • Communicate openly, honestly, and in a timely manner.
    • Treat the Participant with courtesy, dignity, and respect.
    • Consult with the Participant on decisions about how supports are provided.
    • Provide a safe and secure environment for the delivery of supports.
    • Give the Participant information about managing any complaints or disagreements.
    • Maintain accurate records of the supports provided to the Participant.
    • Protect the Participant's privacy and confidential information in accordance with all relevant laws and Upper Coomera Classes privacy statement.
    • Provide the Participant with a copy of this signed Agreement.
  6. Responsibilities of the Participant
    • Treat the Provider's staff with courtesy and respect.
    • Communicate openly and honestly with the Provider about their needs and preferences.
    • Provide the Provider with all necessary information to deliver safe and effective supports.
    • Notify the Provider if their NDIS plan is suspended, replaced, or if they stop being a participant in the NDIS.
    • Pay for the supports and services in a timely manner, as per the agreed payment terms.
  7. Schedule of Supports and Pricing: The supports and services to be provided, along with their associated costs, are detailed in the Schedule of Supports (Attachment A). All prices are subject to the current NDIS Pricing Arrangements and Price Limits and are subject to change in line with new NDIS price guides.

    This service agreement is for programs delivered by Upper Coomera Classes consisting of three three-hour sessions of kinetic activities to produce art and craft, and one session for the sale of these created products at a market stall.

    This agreement is for the following program:

    • Plaster and Candle Making
    • Artisan Soap Making
    • Paints, Pots and Plants
    • Pencil to Paint
    • Artisan Candles
    • Plaster Masterpiece
    • Paint and Sip
    • Artisan Resin Masterpiece

    Each program consists of three (3) x three-hour classes and an on-site market stall. The price per hour of the three-hour classes is detailed in the Schedule of Supports (Attachment A). There is no charge for participation in the market stall.

    The program is pay-as-you-go of each class with no upfront costs. There is no obligation of the Participant to complete all three classes, or participate in the market stall.

    For all three sessions, the total cost for the program is: $540.00 for weekday programs, $720.00 for Saturday programs, and $900.00 for Sunday programs (including GST if applicable).

  8. Market Stall The Participant will have the opportunity to sell the products they create during the classes at a market stall organised by the Provider. The market stall will be held at a location and time to be confirmed by the Provider. There is no additional cost to the Participant for attending the market stall.

    The Participant is responsible for the pricing and sale of their own products at the market stall. The Provider will not take any commission or fee from the sales made by the Participant.

  9. Inclusions and Exclusions: The cost of the supports includes all materials and resources required for the classes and market stall. Any additional costs, such as transportation to and from the venue, are not included and are the responsibility of the Participant.

    The location of the market stall will be confirmed with the Participant at least two weeks prior to the event. The Provider will make reasonable efforts to accommodate any specific needs or requests of the Participant, but cannot guarantee that all requests will be met.

  10. Support Worker Inclusion: The Participant may choose to have a support worker or aide accompany them to the classes and market stall. If the Participant requires a support worker, they must inform the Provider prior to the commencement of the program. The support worker is the responsibility of the Participant and must comply with all relevant policies and procedures of the Provider while on-site.

    The support worker will not be charged for attending classes or the market stall, but any additional costs incurred by the support worker, such as transportation or meals, are the responsibility of the Participant.

    The Participant's support worker is welcome to participate in the crafting activities. There will be no addition cost to the Participant or Support worker for their participation.

    The Provider reserves the right to refuse entry to any support worker who does not comply with the Provider's policies and procedures or who poses a risk to the safety and well-being of other participants or staff.

  11. Location and Time of Services: The services will be provided at Upper Coomera Classes, located at 16 Betty St, Upper Coomera QLD 4209. Classes will be held on Tuesday, Thursday and Saturday from 10:00am to 1:00pm for a duration of three hours per session. Time and location of the market stall will be confirmed, but generally will be held on the last Sunday of the month from 7:00am to 10:00am.

  12. Billing and Payment: Payment for services will be managed according to the Participant's chosen funding option:

    • NDIA-Managed: The Provider will submit claims for payment directly to the NDIA via the myplace portal.
    • Plan-Managed: The Provider will invoice the Participant's Plan Manager, for services delivered.
    • Self-Managed: The Provider will invoice the Participant or the Participant's coordinator for services delivered.

    Invoices will be issued at the end of the class and are payable within 7 days of the invoice date. Payment can be made via bank transfer.

  13. Cancellation Policy: The Provider needs to be notified before the start of the class of any cancellations or rescheduling. Cancellations made after the class has started will not be eligible for a refund or credit. If the Participant is unable to attend a class, they can call 1800 552 336, text 0491 131 072 or email [email protected] to notify the Provider of a cancellation. If the Participant fails to provide this notice, the Provider reserves the right to charge the full price for the class for the cancelled support.

  14. Complaints and Disputes: The Provider is committed to resolving any concerns in a fair and timely manner. If the Participant is unhappy with the services provided, they should contact the Provider's designated complaints officer Michael Bamford at [email protected].

    If the matter cannot be resolved, the Participant has the right to contact the NDIS Quality and Safeguards Commission on 1800 035 544 or via their website at https://www.ndiscommission.gov.au/contact-us.

  15. Privacy and Confidentiality: The Provider will handle all Participant information in accordance with the Privacy Act 1988 (Cth) and the NDIS Practice Standards - Provider Registration and Practice Standards. Information will only be collected and used to provide safe and effective services, and will not be disclosed without the Participant's consent, except where required by law.

  16. Review and Variation of Agreement: Any changes to this Agreement must be agreed upon in writing and signed by both the Participant and the Provider.

  17. Ending This Agreement: Either party may end this Agreement at any time by giving notice to the other party.
